Terms & Conditions
These Terms & Conditions (“Terms”) govern your use of msitesolutions.com (the “Site”) and any purchase, quote request, or service provided by mSite Solutions (“mSite Solutions,” “we,” “us,” “our”). By using the Site or purchasing services, you agree to these Terms.
If you do not agree, do not use the Site or services.
1) Services We Provide
We provide services including:
Web hosting services (hosting accounts provisioned for your domain)
WordPress website development (custom WordPress builds based on your request/package)
Support & maintenance (updates, fixes, cleanup, and related WordPress support work)
Consultation, setup, and migration assistance (as applicable)
Service availability and features may vary by plan/package and by what is listed on the Site at the time you order.
2) Quotes, Orders, and Acceptance
Quotes. Quote requests submitted through the Site are not binding offers. A quote is finalized only when we confirm scope, pricing, and timeline in writing.
Orders. When you place an order through the Site and payment is successfully processed, the order is considered accepted unless we notify you otherwise. We may decline or cancel an order (and refund payment) if we cannot provide service, if information provided is incorrect, or if there are signs of abuse/fraud.
3) Payments and Payment Processing
Payment processor. Payments are processed through PayPal. Your use of PayPal is governed by PayPal’s own agreements and policies. PayPal+1
Fees. Prices are shown on the Site and/or at checkout. You are responsible for any applicable taxes or fees charged by third parties (if any).
Failed payments. If a payment fails or is reversed, we may pause provisioning, suspend service, or cancel the order until payment is successfully completed.
Chargebacks / disputes. If you file a payment dispute or chargeback, we may pause work and/or suspend service while the dispute is being resolved. PayPal may apply its own dispute and buyer protection rules. PayPal+1
4) Hosting Terms (Standard/Business Hosting and Included Hosting)
Account provisioning. We provision hosting for the domain you provide at checkout. You are responsible for ensuring the domain is correct and that you control DNS for the domain.
Nameservers / DNS. We will provide nameserver information when your hosting account is ready. DNS changes can take time to propagate and are outside our control.
Resource use. Hosting accounts are subject to reasonable resource usage limits and acceptable use rules (see Section 10). Excessive usage, abuse, or security issues may require us to throttle, suspend, or request changes.
Suspension for security/abuse. Hosting providers commonly suspend sites for issues like malware, phishing, spam, or policy violations. If your site is compromised or abused, we may suspend service to protect the server and other customers. SiteLock+1
Backups. We may maintain backups as part of hosting operations, but backups are not a guarantee. You are responsible for maintaining your own copies of important content and files.
5) Website Development Terms (Basic/Advanced/Premium Website Work)
Scope of work. Website work is based on the package you purchase and the scope we confirm with you. Features not included in scope (for example: advanced custom functionality, third-party integrations, e-commerce, membership systems, custom API work, large content entry, or extensive copywriting) may require additional fees.
Client inputs. You are responsible for providing timely access and inputs needed to complete the project, which may include:
logo/branding assets
written content and images (or instructions for what you want)
example sites/branding direction
access to domain/DNS and any existing hosting/WordPress admin access (when applicable)
Third-party plugins/services. Some features may require third-party plugins or services (free or paid). Any third-party costs are your responsibility unless we explicitly say otherwise.
Delays and inactivity. If a project is delayed due to missing client content, approvals, or access, timelines may shift. We may close or pause projects after extended inactivity.
Launch. “Launch” typically means publishing the site to your live domain. Ongoing edits after launch are handled as support/maintenance or as a separate scope unless included in your package.
6) Revisions and Change Requests
Unless stated otherwise in your package/scope confirmation:
Reasonable revisions are allowed during the build phase.
Requests that materially change direction, add new pages/features, or expand scope are treated as change requests and may require additional time and fees.
7) Domains
We do not sell domain registrations on the Site. You are responsible for purchasing, renewing, and maintaining your domain registration with your chosen registrar.
We may provide guidance for DNS setup, but domain availability, renewals, and registrar issues are managed by you and your registrar.
8) Communications
We may contact you by email regarding:
order confirmation and service delivery
onboarding steps (hosting setup, website intake)
project updates, approvals, and support communications
If you do not respond to required questions or requests for access, your service/provisioning may be delayed.
9) Cancellations, Refunds, and Termination
Because we offer both digital services and hosting, refunds depend on what has been delivered/used:
Hosting (annual terms).
If hosting has been provisioned and used, refunds (if any) are limited and may be prorated or may be unavailable depending on timing and external provider costs.
Non-payment at renewal may result in suspension and eventual removal of data. We are not responsible for loss of content due to non-renewal.
Website development (one-time work).
Once work has started, refunds are generally not available for time already spent or deliverables already provided.
If we have not started work and you request cancellation promptly, we may refund at our discretion (minus payment processor fees, if applicable).
Premium package.
The Premium package includes both hosting provisioning and website work. Refund eligibility may differ for each component.
Termination for cause.
We may suspend or terminate service if:
you violate the Acceptable Use rules (Section 10),
you engage in abusive behavior toward our staff,
your site is used for unlawful activities,
you fail to pay for services,
your site threatens the security/stability of systems.
10) Acceptable Use (AUP)
You agree not to use our services to host, transmit, or distribute:
malware, phishing, scams, or deceptive content
spam or unauthorized bulk messaging
illegal content or activities
content that infringes intellectual property rights
attempts to gain unauthorized access to systems/networks
If we believe your account is involved in abuse or security risk, we may suspend service without notice to prevent harm. SiteLock+1
11) Intellectual Property
Your content. You retain ownership of your content (text, images, logos) you provide.
Our work product. Upon full payment, you receive a license to use the website deliverables we create for you. Third-party themes/plugins remain subject to their own licenses.
Portfolio. Unless you request otherwise in writing, we may reference your site as part of our portfolio (for example, a screenshot and a link).
12) Warranties and Disclaimers
We provide services on an “as-is” and “as-available” basis. We do not guarantee:
uninterrupted uptime or error-free operation
perfect compatibility with every browser/device/plugin
ranking, traffic, sales, or SEO results
that third-party services will be available or bug-free (registrars, payment processors, plugins, hosting upstream providers)
13) Limitation of Liability
To the maximum extent allowed by law:
mSite Solutions will not be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption).
Our total liability for any claim relating to services is limited to the amount you paid to us for the specific service giving rise to the claim during the 3 months before the event (or the total paid for the specific one-time project, whichever is lower).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14) Indemnification
You agree to indemnify and hold harmless mSite Solutions from claims, damages, and expenses arising out of:
your content,
your use of the services,
your violation of these Terms,
any unlawful use of your site or account.
15) Changes to These Terms
We may update these Terms from time to time. Continued use of the Site or services after changes means you accept the updated Terms.
16) Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules.
